Terms & Conditions for Digitalladdex

Welcome to Digitalladdex. These Terms and Conditions apply to your use of our web site and our development of web sites. You are obliged to abide by these terms by visiting our site or by using our services.

Unless you are in agreement with all this, then you should not use our services or the site.

Definitions

“Company” refers to Digitalladdex

The term services is used to refer to all services associated with the development of the web site such as the design, development, maintenance and other associated solutions.

Client / You: any person or company using our services.

Scope of Services

Digitalladdex provides:

• Tailored web development solutions.
• Services in web design and development.
• Development of Ecommerce websites.
• Services to develop websites with WordPress.
• Web maintenance and support.
• The delivery of all services is according to agreed project scope, timelines and requirement.

Project Engagement

A project comes into being once scope, timeline and pricing are agreed and confirmed.

Clients have to submit all the necessary content, materials, and approvals in time.

Latency in responding to clients can affect delivery times.

Client Obligations

To make sure that the project will be completed on time, the Client will:

Delivery of Materials: Supply all the text, graphics, logos, and information, needed to complete the project within seven (7) business days of the project commence date.

Timely Feedback: The feedback or approvals on the deliverables must be provided within three (3) business days. Failure to give feedback promptly will automatically extend the project deadline.

Accuracy: check the accuracy of all information to be submitted to the Company and make sure that the Client is entitled to use all materials provided.

Pricing & Payments

Pricing is all shared prior to commencement of projects.

Payments can be in milestones or advance (as agreed).

Invoices of GST are given in all transactions.

Inability to make payments can lead to the suspension or termination of the project.

Refund Policy

Non-Refundable Deposits: This is because the first deposit/ down payment is not refundable when there is work in progress or resources assigned to the project.

Milestone Payments: These are payments that are made when specific milestones in the project have been achieved.

Discretionary Refunds: All other refund requests will be done on a case by case basis and would solely be at the sole discretion of Digitalladdex, but they would exclude any labor costs or third party services.

Delivery Timeline

Normal delivery schedules are between 7 14 days in the case of normal projects.

Depending on requirements, complex projects can be lengthy.

The client (content, approvals, etc.) delays are not under the responsibility of Digitalladdex.

Revisions & Changes

We do the revisions according to the agreed scope.

Any further revisions or scope increases can be subject to additional fees.

Significant modifications following the project approval might need an additional contract.

Intellectual Property

The client is entitled to the finished web design and content (minus third-party tools or licensed assets) on full payment.

Digitalladdex reserves the right to exhibit the finished projects in its portfolio.

Third-Party Tools & Services

We can utilise third-party tools including:

• Hosting providers
• Payment gateways
• Plugins and APIs

Digitalladdex does not bear the responsibility of problems with third-party services.

Maintenance & Support

• Continued assistance is assisted on the basis of the chosen plan or agreement.
• Maintenance encompasses updates, bug fixes and performance checks.
• Other support requests are chargeable.

Cancellation & Termination

• The termination of the project may occur with a notice.
• Once work has started, it is not possible to make payments back.
• Upon termination (when payment is made), any work done will be delivered.

Limitation of Liability

Digitalladdex will not be liable to:

• Loss of business or revenue or loss of data.
• Third party services that result in downtime of the websites.
• Delays due to external causes.
• We are only liable to the extent of payment of the services.

Confidentiality

• We appreciate your business information and uphold a high level of confidentiality.
• No information about the client will be disclosed without their permission, unless it is necessary by the law.

Governing Law

• The laws of India apply to these Terms & Conditions.
• Disputes will be under the jurisdiction in India.

Modifications

Digitalladdex has the right to revise or change these Terms and Conditions any time. News will be updated on this page.
